EB-3 Immigrant Visa Program q&a

1. WHAT IS THE EB-3 VISA PROGRAM?

  • The US government offers an opportunity for eligible applicants to work and immigrate to the USA under the EB-3 U.S. Employment-Based 3rd Category Immigrant Visa Program

  • This program is designed to satisfy the labor market demand for unskilled workers in the United States

  • Applicants can include their spouse as well as any children they have below the age of 21 in their EB-3 application 

  • One primary applicant can obtain a green card for every member of his/her family

2. WHO CAN QUALIFY?

  • Any person 18 years and over with legal status in the U.S.

  • No special skills, degrees, or experience are required for unskilled workers

  • The 'Other Workers' subcategory is for persons performing unskilled labor requiring less than 2 years training or experience

3. WHICH COUNTRY CAN QUALIFY?

  • China, India, and the Philippines could be delayed due to backlog

  • Those with an expired visa or illegal immigrant statuses do not qualify

  • Those any criminal background both in the US or home country do not qualify

  • Normal processing takes 18-24 months on average for domestic applicants.

  • However, it may take longer than normal due to the immigration backlog process

10. WHO IS GOING TO PROCESS THE EB-3 PROGRAM?

  • I-140 Application to USCIS Immigration petition process for an alien to work in the US on a permanent basis

  • I-485 Application to register Permanent Residence for adjustment of status

  • I-765 Application to request an employment authorization document (EAD)

11. WHAT WILL BE THE JOB DESCRIPTION?

  • This EB-3 'Other Workers' program is for the unskilled job that is not required any special education or experience

  • Applicants would obtain a job description from the employer since each employer has a different job description. Following are the examples

  • Caregivers work in the home and help their clients with daily activities, such as bathing and bathroom functions, feeding, grooming, taking medication, and some housework. Caregivers help clients make and keep appointments with doctors, provide or arrange transportation, and serve as a companion for their clients. However, this job requires basic English skills to communicate with the employer and clients.

  • Food processing workers usually work on fast-moving production lines, which have food passing along conveyor belts and through different stages, such as mixing, cooking, and packing. They might work with frozen, canned, baked, dried, or pasteurized products.

12. WHAT WILL BE THE PAY RATE OR BENEFITS FROM MY EMPLOYER?

  • This EB-3 'Other Workers' program is for the unskilled job and easy to be trained 

  • Each employer have a different job description, pay rate according to prevailing wage by each location and that will be determined by the Department of Labor (DOL)

  • Each employer will give a full-time job and issue a W-2 form according to the assigned job and duty

  • It is your responsibility to ask your employer about benefits and vacation policy when you have a job interview
